Terms of Use for ProsList

These Terms of Use ("Terms") govern your access to and use of the ProsList platform operated by ProsList LLC, located at 8026 Lawndale Ave., Skokie, Illinois 60076 ("ProsList," "we," "us," or "our").
By accessing or using ProsList, you agree to be bound by these Terms.
1. Platform Overview
ProsList is a technology platform that connects homeowners, service professionals (“Pros”), marketplace sellers, and event creators. ProsList does not employ, supervise, manage, or control any Pro or seller listed on the platform and is not responsible for their actions, services, or conduct.
2. Independent Contractors
All Pros operate as independent contractors. Pros are solely responsible for licensing, insurance, permits, compliance with laws, service quality, pricing, and workmanship. ProsList does not guarantee the qualifications, reliability, or performance of any user.
3. No Guarantee of Services or Listings
ProsList makes no representations or warranties regarding the quality, safety, legality, availability, timeliness, or results of any services, marketplace listings, or events posted on the platform. All interactions are at your own risk.
4. Payments and Subscriptions
Certain features of ProsList require a paid subscription. All payments are processed through Apple’s In-App Purchase system. ProsList does not collect or store full payment information.
Subscriptions automatically renew unless canceled through your Apple account settings. Pricing, billing terms, and subscription details are displayed within the app prior to purchase.
5. Refunds
All purchases are processed by Apple. Refund requests must be submitted directly to Apple and are subject to Apple’s refund policies.
6. User-Generated Content
Users may post content including text, images, listings, and other materials. You retain ownership of your content but grant ProsList a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content within the platform.
ProsList is not responsible for user-generated content and does not guarantee its accuracy or legality.
7. User Conduct
You agree not to:
- Post false, misleading, or unlawful content
- Impersonate others
- Harass or harm other users
- Violate any laws or regulations
- Misuse or exploit the platform
ProsList reserves the right to remove content, restrict access, or terminate accounts at its sole discretion.
8. Disputes Between Users
ProsList is not responsible for disputes, damages, refunds, chargebacks, injuries, losses, or service disagreements between users. Users agree to resolve disputes directly with one another.
9. Indemnification
You agree to indemnify, defend, and hold harmless ProsList LLC, its owners, employees, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of your use of the platform, your violation of these Terms, or your interactions with other users.
10. Limitation of Liability
To the fullest extent permitted by law, ProsList LLC shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or relating to your use of the platform, even if advised of the possibility of such damages.
11. No Warranty
The platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. ProsList disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.
12. Account Suspension & Termination
ProsList may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, abuse of the platform, or any conduct deemed harmful to the community.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
14. Changes to Terms
ProsList may update these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.
